Send in the original or a copy of your receipt indicating the purchase of one or more Participating Brand Products at a Sponsor Grocery Store ("Products Receipt"), with the Participating Brand Products highlighted, along with your name, age, return address, telephone number, and (optional) email address (all of which you may provide on an official Movie Madness Sweepstakes entry form available at Cinemark Movie Madness Displays at Sponsor Grocery Stores and Cinemark Movie Theatres in Houston and Beaumont) to KLDE c/o Movie Madness, 1990 Post Oak Blvd., Suite 2300, Houston, TX 77056. For each individual Products Receipt that Sponsor receives from you, you will be entered once (1) into the Grand Prize drawing. Each Products Receipt must be submitted in a separate stamped and addressed envelope postmarked on or before May 10th 2004. You will not receive any more than one (1) entry into the Grand Prize drawing per envelope and per receipt.
II.) No Purchase Necessary - Just Mail In an Entry Form: You may also enter by picking up an official entry form available during the Sweepstakes Period at Cinemark Movie Theatres, or at the Cinemark Movie Madness Displays at Sponsor Grocery Stores. Complete and mail your official entry form to KLDE c/o Movie Madness, 1990 Post Oak Blvd., Suite 2300, Houston, TX 77056. Maximum of one (1) entry will be accepted per stamped envelope. All mail-in entries must be post-marked on or before May 10th 2004.
3. DRAWING WINNER SELECTION, NOTIFICATION AND ACCEPTANCE. Random drawings from a combined pool of all eligible Products Receipt entries and all eligible mailed entry forms postmarked by May 10th 2004. Grand Prize Drawing will be conducted on or about May 12th 2004 to select one (1) Grand Prize winner and ten (10) Runners-Up Prize winners. Winners will be notified by telephone or email.
4. PRIZES AND ODDS OF WINNING: Runners-Up Prizes: A. Ten (10) Runners-Up Prize winners will be randomly selected from among all eligible entries received to win 10 Cinemark movie passes. (ARV: $75.00).
Grand Prize: One (1) Grand Prize winner will be randomly selected from among all eligible entries received to win A Trip for Four to any Beaches Resorts in Jamaica - the Caribbean's #1 Ultra All-Inclusive Resorts for families, for fun, for everyone! (1 Room for a family of four standard rooms). (a $25.00 per night service charge will apply to each winner, holidays are excluded, subject to space availability, valid for approximately one year from the promotion date) Plus coach class round-trip tickets, excluding taxes, approximately $102 p.p & a $50 p.p. processing fee (processing fee & taxes are the responsibility of the winners) from Houston to Jamaica. 3night trip to Beaches averages $2500.00 (2adults/2kids under 15yr.) (Grand Prize winner, wins $1,000 cash to cover costs of room taxes, fees, etc). (ARV: $3,500)Winner and his or her travel companions are responsible for meals, beverages, airport transfers and all other expenses associated with Grand Prize trip not expressly identified above. 5. ELIGIBILITY AND LIMITATIONS. No purchase required. The purchase of Participating Brand Products will not increase your chances of winning. Only Participating Brand Products purchased from the listed Sponsor Grocery Stores during the Sweepstakes Period will qualify for entries in the Sweepstakes. Participants and winner(s) must be legal U.S. Citizens and be current Texas residents at least 18-years old at time of entry. Employees of Sponsor, the Sponsor Grocery Stores and their respective advertising agencies, employees of other radio or television stations, and members of the immediate family of all the foregoing persons and all others with whom they are domiciled, are not eligible to participate and win. The term "immediate family" includes spouses, siblings, parents and children, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension. Participants will be deemed to be domiciled with other persons residing at the same household, whether or they are not related.
6. PUBLICITY; USE OF PERSONAL INFORMATION. Except where prohibited by law, by participating, all participants and winner(s) grant Sponsor exclusive permission to use their names, characters, photographs, voices, and likenesses for any promotional purpose and waive any claims to a royalty, or other compensation for such use.
7. RELEASE. By participating in the Sweepstakes, each participant and winner waives any and all claims of liability against the Sponsor, its employees and agents, the Sponsor Grocery Stores, other Sweepstakes Sponsors and all of their respective employees and agents, for any personal injury, injury to or loss of property, or financial loss, which may occur from the conduct of, or participation in, the Sweepstakes, or from the use of any prize, or travel to or from any prize-related activity. In order to receive a prize, Grand Prize winner and Runners-Up must sign an affidavit of eligibility and liability/publicity release form to be provided by the Sponsor. Persons traveling as companions (and the parents or legal guardians of any minor traveling companions) of Grand Prize winner must also sign a liability release to be provided by Sponsor before airline tickets or other components of Grand Prize will be awarded.
8. TAXES. Any valuation of the prize(s) stated above is based on available information provided to Sponsor, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for paying any and all applicable taxes related to the prize(s) and for paying any expenses associated with any prize which are not specifically provided for in the official rules. The Grand Prize Winner must provide Sponsor with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize. Notwithstanding the foregoing, all prizes are subject to availability and Sponsor reserves the right to substitute, in its sole discretion, any prize or prize component with a prize or component of equal or greater retail value. The Grand Prize winner will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
9. DECISIONS. By participating in the Sweepstakes, participants agree to be bound by the decisions of Sponsor. Sponsor reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who Sponsor believes has violated any rule, gained unfair advantage in participating in the Sweepstakes, or obtained winner status using fraudulent means. Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes and all such decisions shall be final in all respects. If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of Sponsor, Sponsor reserves the right to terminate or modify this Sweepstakes, or make such other decisions regarding the outcome as Sponsor deems appropriate. Sponsor may waive any provision of these rules in its sole discretion.
10. MISCELLANEOUS. Sponsor may substitute prizes, amend the rules or discontinue the Sweepstakes at any time as announced on the Station(s). Sponsor disclaims any responsibility to notify participants of any aspect related to the conduct of the Sweepstakes. Written copies of these rules are available during normal business hours at the business offices of the Station(s), on the station websites and by mail upon written request with a stamped, self-addressed return envelope.
